Divorce in Texas

60-Day Waiting Period

Texas law imposes a mandatory 60-day waiting period between filing and final decree, even if both spouses agree on all issues

Discrimination by Businesses

Uncontested Divorce

When spouses agree on property division, custody, and support, we aim to finalize the divorce within 60–90 days

Contested Divorce

Disputes over assets or children can extend timelines to 6–12 months or longer, depending on overall case complexity.

Accelerating Your Case

Complete financial affidavits promptly.
Use mediation or collaborative law to resolve disputes quickly.
Work with an attorney who is familiar with the Texas Family Code and the Texas Code of Civil Procedure.
Preemptively draft required documents to finalize the divorce, such as the Final Decree of Divorce.

Child Custody & Visitation

Best Interest Standard

Under Texas law, the child’s best interest is the primary consideration in conservatorship, possession, and support decisions.

Standard Possession Order

The Standard Possession Order (SPO) grants non-custodial parents specified periods, including weekends, holidays, and summer breaks. The State provides a calendar that details the SPO here: Parenting Time Schedule | Office of the Attorney General. Custom schedules can be agreed to or ordered by the court in specific situations.

Modifications & Relocation

If there’s been a significant change in circumstances, like job loss, relocation, or safety concerns, we file the necessary motions and present evidence to request the orders be modified according to your, or your child’s, specific needs.

Child Support, Financial Obligations, and Enforcements

Calculating Support

Child Support is calculated according to the parents’ net monthly income and the number of children, among other factors. It is important to ensure child support is calculated correctly and according to Texas Law, something we will ensure happens in each of our cases involving financial obligations.

Additional Expenses

Courts may order additional contributions for health insurance, extracurricular activities, and special education needs.

Enforcement

If allegations of order violations exist in your case, we can file on your behalf, or defend you against, a Motion to Enforce and for Contempt, which may have consequences for the party alleged to have violated prior court orders, including but not limited to: fines, jail time, and/or paying the other party’s attorney’s fees.
